Prisión domiciliaria para un mendigo

Un juez de Sao Paulo (Brasil) ordenó prisión domiciliaria para un mendigo procesado por robo, que podría enfrentarse a pena de cárcel por incumplir el dictamen de la justicia al no tener un lugar donde vivir. La decisión del juez fue publicada el viernes, según el sitio web de la ONG Instituto de Defensa del Derecho a la Defensa (IDDD), a cargo de la defensa del acusado. En octubre, Nelson Renato da Luz fue sorprendido
robando unas placas de aluminio de una estación del metro y fue encerrado durante el juicio. "En el proceso faltaba la información de que Nelson era mendigo, hecho que no fue abordado por la defensa para no estigmatizar aún más a un reo que tiene condición de trastorno mental", indicó el IDDD. "Era innecesario entrar en la discusión de si era mendigo porque no fue solicitada su prisión domiciliaria, se pidió su libertad", precisó el abogado Marcelo Feller. En su decisión, el juez Figueiredo Gonçalves señala que Da Silva no debería ser internado, ya que no cometió un crimen con violencia o una amenaza grave, pero por otro lado considera que no puede estar en libertad porque podría reincidir en los delitos juzgados. De ahí la decisión de arresto domiciliario. Marcelo Feller cree que la próxima semana el juez modificará la decisión y dará a Da Silva "un beneficio compatible con su situación".

In its decision, the judge Figueiredo Gonçalves Da Silva said that there will be no imprisonment because he didn't commit a crime of violence or a serious threat, but on the other side  he thinks he can't be released because it could relapse into crimes trial. So he made the decision of a house arrest. Marcelo Feller believes that next week the judge amended the decision and give Da Silva "a benefit consistent with his situation."
